By accessing and using thewilkinsonfirm.com and related services, including staffing inquiry forms, job applications, pre-qualification assessments, team portal access, and consultation requests (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Services Description
The Wilkinson Firm, LLC ("Company," "we," "us," "our," or "TWF") provides staffing services, HR consulting, and talent solutions including:
- Staffing inquiry and request forms
- Job applications for open positions
- Pre-qualification assessments and evaluations
- Team portal access for partners and staff
- HR consulting and diagnostic services
- Talent placement and retention support
3. Age Requirement and Eligibility
To use our Services, you must be at least 18 years of age. By using our Services, you represent and warrant that you are at least 18 years of age and legally capable of entering into binding agreements.
4. User Accounts and Registration
If you create an account with us, you agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your password and account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or contain false or misleading information.
5. Acceptable Use
You agree not to use our Services for any unlawful purposes or in violation of any applicable laws or regulations. Prohibited activities include, but are not limited to:
- Harassing, threatening, or defaming others
- Submitting false or misleading information
- Attempting to gain unauthorized access to systems or data
- Transmitting viruses, malware, or harmful code
- Engaging in discriminatory or abusive conduct
- Violating intellectual property rights
6. Intellectual Property Rights
All content, design, graphics, and other materials on our Services (including text, images, logos, and software) are owned or licensed by The Wilkinson Firm and are protected by copyright and trademark laws. You may not reproduce, distribute, or transmit any content without our prior written permission.
7. Limitation of Liability
To the fullest extent permitted by law, The Wilkinson Firm and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, even if we have been advised of the possibility of such damages.
8. Disclaimer of Warranties
Our Services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or secure.
9. Indemnification
You agree to indemnify and hold harmless The Wilkinson Firm and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of our Services
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your violation of others' rights
- Any false or misleading information you provide
10. Termination
We reserve the right to terminate or suspend your access to our Services at any time, without notice and without cause. Upon termination, all rights granted to you are immediately revoked, and you must cease using the Services.
11. Modification of Terms
We may modify these Terms at any time by posting the modified terms on our Services. Your continued use of our Services following the posting of modified terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically for updates.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from or relating to these Terms or your use of our Services shall be brought exclusively in the state and federal courts located in DeKalb County, Georgia.
13. Arbitration Clause
Except as otherwise provided, any dispute, claim, or controversy arising from or relating to these Terms or your use of our Services shall be resolved by binding arbitration in DeKalb County, Georgia, administered in accordance with the rules of the American Arbitration Association. Each party agrees to bear its own attorney's fees and costs.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Wilkinson Firm regarding the use of our Services and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Waiver
The failure of The Wilkinson Firm to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision of these Terms.
17. Third-Party Links
Our Services may contain links to third-party websites and services that are not operated by us. We are not responsible for the content, accuracy, or practices of these third-party sites. Your use of third-party sites is subject to their terms and policies. Please review their privacy policies and terms of service before providing any information.
18. Electronic Communications and SMS Messaging
By using our Services, you consent to receiving communications from us, including newsletters, updates, and important notices, via email or other methods. You may opt out of marketing communications by following the unsubscribe instructions in such communications.
18.1 SMS Messaging Program (TWF Portal SMS)
The Wilkinson Firm operates a transactional SMS messaging program (“TWF Portal SMS”) for our W-2 employees and 1099 contractors. By providing your mobile phone number and opting in through either the portal at portal.thewilkinsonfirm.com or via your signed employment / contractor agreement, you agree to the following SMS-specific terms:
Program description. TWF Portal SMS sends transactional messages about your work assignments — shift confirmations, schedule changes, arrival reminders, account security verification codes, and urgent operational alerts. The program does not send promotional or marketing messages unless you separately opt in to that distinct program.
Message frequency. Variable, typically 2–8 messages per week per active staff member, driven by event schedule. Frequency may be higher in the 24 hours surrounding a scheduled event.
Message and data rates. Standard message and data rates from your mobile carrier may apply. The Wilkinson Firm does not charge for SMS messages, but your wireless carrier may.
Opt-out at any time. Reply STOP, UNSUBSCRIBE, CANCEL, QUIT, or END to any message to immediately stop receiving SMS from The Wilkinson Firm. You will receive one final confirmation message and then no further messages until you opt back in.
Re-opt-in. Reply START or YES to any prior message thread to resubscribe.
Help. Reply HELP to any message for support contact information, or email [email protected].
Supported carriers. AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, MetroPCS, US Cellular, Virgin Mobile, Cricket Wireless, and other major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages.
Eligibility. You must be an active employee or contractor of The Wilkinson Firm and at least 18 years of age to receive SMS messages from us.
Privacy. Your phone number, opt-in records (including timestamp, consent text shown to you, and IP address), and SMS message history are stored in our secure portal database hosted on Cloudflare D1 (U.S. datacenter). See our Privacy Policy for full details on how this information is collected, used, retained, and protected.
No liability for carrier filtering. The Wilkinson Firm is not liable for delayed, undelivered, or filtered messages, including messages affected by carrier-side spam filtering, device-side blocking, network outages, or your mobile plan limitations.
Marketing SMS (separate consent). If you opt in to receive recruitment, hiring, or promotional SMS from The Wilkinson Firm, that constitutes a distinct, additional consent. You can opt out of marketing SMS independently of transactional SMS by replying STOP to a marketing message, which will not affect your transactional message receipt.

20. Survival
The provisions of these Terms that by their nature should survive termination, including but not limited to Intellectual Property Rights, Limitation of Liability, Disclaimer of Warranties, Indemnification, Governing Law, and Arbitration Clause, shall survive any termination of these Terms or your access to our Services.
